That certainly isn't clear to me. Here is what it says:
"* terminate this aggreement and retain your deposit(s) as liquidated
damanges; or
* exercise any other right or remedy under applicable law or equity
It doesn't say the seller's only remedy is the avenue of liquidated
damages. It gives them the choice of either that or other remedy,
which would be to sue you for their actual damages....
